Is the nec 3520 or 3500 available in retail stores, rebadged or not?

Yes, the NEC 3500 sold as the Mad Dog Brand, Mega Stor MD-16XDVD9 at CompUSA for $89.99.

The new Memorex 16x Dual Layer drive is also a rebadged 3520 (internal version is...not the external)

External Memorex is a 3500.

Newer external Memorex drive that I saw at CES was an NEC ND-3520A ;)

the new external memorex's that we have in our staples store looks like a NEC, the way the eject button is kinda sunk into the drive

They did.. sorta. There retail drives are only available through online stores, not places like Best Buy (yet).
